Adjournments
Adjournments will only be granted for good cause shown no later than 24 hours before your scheduled appearance date and time.
Resolution of Vehicle and Traffic Violations
ONLY FOR TRAFFIC INFRACTIONS:
1). A not guilty plea is made by signing and dating Section B on the right side of the summons and mailing it to the Court, the Court will then mail you a date to return to speak with the Town Prosecutor.
2). A guilty plea is made by signing and dating Section A and mailing the summons to the Court. The fine will be determined by the Judge and mailed back to you, this then must be paid promptly.
Traffic Misdemeanor or Felony
YOU MUST APPEAR IN PERSON FOR ARRAIGNMENT
Please do not ask the Court Clerk to transfer a matter from one Judge to another.
Payments
Fine payments cannot be accepted over the phone
Acceptable payments include Visa, MasterCard, Cash, or local personal checks.

ALL CREDIT/DEBIT CARD PAYMENTS.
Bail
Bail is set to assure the appearance of the party charged and will be held by the Court until final disposition of the charges. Bail can ONLY be returned to the party who posted the bail with their original bail receipt AND proper ID.
Small Claims
You may file a Small Claims matter at the Court Clerk’s Office. Small Claim proceedings may be brought by any individual against anyone who resides or owns a business in the Town of Marilla. It is the petitioner’s responsibility to make sure the residence/business is in the Town of Marilla.
The maximum claim allowed is $3,000. If the amount you are suing for is $1.00 to $1,000.00, the filing fee is $10.00. If the amount you are suing for is $1,001.00 to $3,000.00, the filing fee is $15.00.
The filing fee is payable upon filing the application. The Court Clerk cannot accept an application without the filing fee. Small Claims filings are accepted at the Court Clerk’s Office
